Bill 109 passed in 2022 .It gives the approval authority the ability to reinstate a lapsed draft plan approval. The lapse date must have been within the past 5 years. It is a one-time ability to reinstate the draft plan. A sworn affidavit is required of the developer to state there are no Agreements of Purchase and Sale for the lands in the lapsed draft plan. No further extensions are permitted.
